This page provides general information about California law and local procedures as they apply to injuries in Novato. It is not legal advice, and reading it does not create an attorney-client relationship. Every case depends on its own facts. For advice about your specific situation, consult a licensed California attorney.

If you were hurt in a car crash, a bicycle or e-bike collision, or a pedestrian accident in Novato, the details that shape the claim are local: whether Novato police or the CHP took the report, whether the crash happened on one of the city streets Marin County has already flagged for repeat collisions, and whether a public agency such as the City, Caltrans, or SMART is involved. Those facts decide who you file against, how you get the report, and which deadline applies.

I’m Sami Sedghani, a personal injury lawyer. My office is in downtown San Rafael on 4th Street, a short drive south of Novato on Highway 101. This page covers what is specific to injury claims in Novato. For the general California rules, see our pages on car accidents, truck accidents, and commercial vehicle accidents.

Who takes the report after a Novato crash

Inside city limits, the Novato Police Department handles collisions on city streets, but it does not send an officer to every one. According to the department’s traffic collision page, Novato police respond to injury collisions and hit-and-runs. If no one was hurt, you may be directed to report it another way. If you were hurt, say so when you call. Pain that seems minor at the scene is still an injury, and a report written at the scene is far more useful later than one assembled from memory.

On Highway 101 and Highway 37, the responding agency is the California Highway Patrol’s Marin Area office at 53 San Clemente Drive in Corte Madera, not Novato police. A crash on an on-ramp or off-ramp can fall on either side of that line, so write down the agency name and report number before you leave the scene.

Getting the report

  • Novato Police Department: collision reports are released online through the My Collision Report system linked from the department’s forms page.
  • CHP Marin Area: reports are requested through the CHP crash report request process, online, by mail, or at the Corte Madera office.
  • Who can get it: under Vehicle Code § 20012, collision reports are confidential and released only to people with a proper interest, such as the drivers and injured people involved, a parent or guardian of an involved minor, their attorneys, and their insurers.

Where Novato crashes happen: the County’s own data

In 2024, the Transportation Authority of Marin and the County of Marin published the Marin County Local Road Safety Plan, with a separate chapter for each city. Its Novato chapter counts 412 injury collisions on the city’s arterial and collector streets from 2017 through 2021, including 18 that caused severe injuries and 6 that were fatal. Those counts do not include crashes on Highway 101 or Highway 37.

The plan names a “High Collision Network” of Novato street segments. Selected segments with the most injury collisions in that period:

Street segmentInjury collisions, 2017 to 2021
Diablo Avenue, Center Road to Reichert Avenue32
Novato Boulevard, Nave Court to Tamalpais Avenue28
Redwood Boulevard, Diablo Avenue / De Long Avenue to Olive Avenue24
Grant Avenue, Monterey Court to Redwood Boulevard20
Rowland Boulevard, Leafwood Drive to Vintage Way17
Ignacio Boulevard, Nave Drive to Entrada Drive17
San Marin Drive, Novato Boulevard / Sutro Avenue to San Carlos Way16
Source: 2024 Marin County Local Road Safety Plan, Transportation Authority of Marin and County of Marin, Chapter 13 (Novato), Table 13.1.

Two other findings stand out. Pedestrian collisions clustered on Diablo Avenue between Center Road and Redwood Boulevard and on Grant Avenue between Reichert Avenue and Fourth Street. And driving or bicycling under the influence was a factor in 24 percent of Novato’s fatal and severe-injury collisions from 2012 through 2021, compared with 10 percent countywide.

Why this matters for a claim

Most crashes are caused by a driver, and the claim runs against that driver’s insurance. Sometimes the road itself is part of the problem: a sight line blocked by vegetation, a missing crosswalk treatment, a signal timed badly for pedestrians. California allows a claim against a public entity for a dangerous condition of public property under Government Code § 835, but the injured person generally has to show the entity created the condition or knew or should have known about it in time to fix it. A published plan that identifies a street as a repeat-collision location is the kind of document that can bear on that question. It does not prove a dangerous condition by itself, and public entities have defenses, including design immunity under Government Code § 830.6. It is a reason to look.

Highway 37 and Highway 101 through Novato

Highway 37 runs east from Highway 101 in Novato toward Sonoma County and Vallejo. A 2017 Transportation Authority of Marin fact sheet describes a 1,500-foot stretch between Highway 101 and Atherton Avenue that was partially or fully closed several times in January and February 2017 when Novato Creek and king tides flooded it. Caltrans plans to replace the Novato Creek Bridge on Highway 37, in part to reduce flooding and adapt to projected sea-level rise, with construction scheduled for 2027.

On Highway 101, Caltrans’ Marin-Sonoma Narrows project opened a third lane in each direction between Novato and Petaluma in September 2025, with some related work continuing. Long-term construction, lane shifts, and standing water all change how a crash is investigated. Two points apply to any of them:

  • Bad conditions do not excuse unsafe driving. California’s basic speed law, Vehicle Code § 22350, requires a speed that is safe for weather, visibility, and the roadway, whatever the posted limit.
  • If a state highway condition contributed to the crash, the claim against the State generally goes through the Department of General Services Government Claims Program within six months, not to the City of Novato.

SMART trains and rail crossings in Novato

Novato has three SMART stations: San Marin, Downtown Novato, and Hamilton. The Downtown Novato station, near Railroad Avenue at the east end of Grant Avenue, opened in December 2019. SMART is operated by the Sonoma-Marin Area Rail Transit District, a public agency. If a crash at a rail crossing or station involves the train, the gates, or SMART property, a government claim to the district is generally due within six months. Olive Avenue and Railroad Avenue, near the downtown tracks, is one of the intersections named in the County’s Novato collision data.

E-bikes and young riders

Novato adopted a local ordinance, effective August 22, 2025, that limits Class 2 (throttle) e-bikes to riders 16 and older, according to the County of Marin’s youth e-bike safety page. When a minor is hurt, two deadline rules work differently. The general two-year filing period for an injury lawsuit is usually paused until the child turns 18 under Code of Civil Procedure § 352. The six-month deadline for a government claim is not paused the same way, although a late-claim application may be available under Government Code § 911.4. If a city street, school property, or a public path is involved, the safer course is to treat six months as the deadline.

Novato intersections and bicycle hotspots

The County’s plan also lists 18 high-collision intersections in Novato. Three had the most injury collisions, five each from 2017 through 2021: Novato Boulevard at Tamalpais Avenue and Seventh Street, San Marin Drive at Redwood Boulevard, and Diablo Avenue at Redwood Boulevard and De Long Avenue. Olive Avenue and Railroad Avenue ranked ninth of the 92 high-collision intersections countywide by collision rate.

Wilson Avenue between Center Road and Novato Boulevard had only eight injury collisions, but the highest collision rate of any Novato segment once traffic volume is taken into account. Bicycle collisions clustered on Diablo Avenue downtown and on Novato Boulevard at Simmons Lane. A Novato advisory issued in November 2025 also reminds riders that Class 3 e-bikes are not allowed on multi-use pathways in Marin County.

Impaired-driving crashes in Novato

Novato’s numbers on impairment stand out. The County found that driving or bicycling under the influence was a factor in 24 percent of the city’s fatal and severe-injury collisions from 2012 through 2021, compared with 10 percent countywide. In a claim against an impaired driver, a few rules matter:

  • The criminal case and the civil claim run separately. A guilty plea can generally be used as evidence in the civil case, but a no-contest plea to a misdemeanor, and a misdemeanor conviction itself, generally cannot. The injury claim has its own deadlines and does not wait for the criminal case to finish.
  • Punitive damages may be available against an intoxicated driver in appropriate cases (Taylor v. Superior Court (1979) 24 Cal.3d 890), under the clear and convincing evidence standard of Civil Code § 3294.
  • California generally bars civil claims against a bar, restaurant, or store for serving alcohol to an adult who later causes a crash (Business and Professions Code § 25602). The exception is a sale to an obviously intoxicated minor (§ 25602.1).
  • Insurance limits usually decide the practical outcome. California public policy generally does not allow insurance to cover punitive damages (PPG Industries, Inc. v. Transamerica Ins. Co. (1999) 20 Cal.4th 310), so your own underinsured motorist coverage can matter as much as the impaired driver’s policy.

School zones and young pedestrians

Novato Unified School District serves about 7,150 students at seven elementary schools, a TK-8 school, two middle schools, and two comprehensive high schools, according to the district. The County’s Novato chapter flags pedestrian hotspots on Diablo Avenue and Grant Avenue downtown. When a child is hit near a school, the questions usually include the driver’s speed in a school zone, crossing guard placement, and whether the school district or city is involved, which brings in the six-month claim deadline.

Claims against the City of Novato

A claim for damages against the City of Novato is made on the City’s claim form and filed with the City Clerk at 922 Machin Avenue, Novato, CA 94945, according to the City’s risk management page. For personal injury, the claim must be filed within six months of the incident (Government Code § 911.2). A lawsuit can follow only after the City acts on the claim or the time for it to act runs out. If the case goes to court, a Novato case is generally filed in the Marin County Superior Court, 3501 Civic Center Drive, San Rafael.

Atención en español

About 27 percent of Novato residents are Hispanic or Latino, according to U.S. Census Bureau QuickFacts. How we prepare an injury case

Before founding Synergist Law, I spent nine years at large law firms handling complex litigation and product liability litigation on behalf of companies. That is where I learned how insurers and defense teams evaluate a claim: which records they request first, and where they look for gaps in causation and damages.

I am also a former clinical pharmacist. In a serious injury case, the medical record often decides the dispute, so I read it with the same questions a defense expert will ask: medication history, gaps in treatment, and whether the treating notes connect the crash to the diagnosis. Neither background predicts how any case will turn out. It shapes how I prepare one.

Frequently asked questions about Novato injury claims

Do Novato police respond to every car accident?

No. According to the Novato Police Department, officers respond to injury collisions and hit-and-runs. Crashes on Highway 101 and Highway 37 are handled by the California Highway Patrol’s Marin Area office, not Novato police.

How do I get a Novato police collision report?

Novato police collision reports are released online through the My Collision Report system linked from the department’s forms page. Under Vehicle Code section 20012, reports are released only to people with a proper interest, such as the people involved, their attorneys, and their insurers.

Who handles a crash on Highway 37 in Novato?

The California Highway Patrol, Marin Area office, at 53 San Clemente Drive in Corte Madera. If a highway condition such as flooding or a construction zone contributed to the crash, a claim against the State generally must be filed with the Department of General Services within six months.

Can I file a claim against the City of Novato for a dangerous street?

Possibly. Government Code section 835 allows a claim for a dangerous condition of public property, but you generally must show the City created the condition or had notice of it, and the City has defenses. The claim must be filed with the City Clerk within six months of the injury. Because the deadline depends on the facts, it is better to have a licensed California attorney determine the deadline that applies than to calculate it yourself.

Do I need a police report if Novato police did not come to my crash?

A report helps, but it is not required to make a claim. If no officer responded, report the crash as the department directs, exchange information, photograph the vehicles and scene, and note witnesses. If anyone was injured, or property damage exceeded $1,000, each driver must also file an SR-1 report with the DMV within 10 days.

Is a crash at a SMART crossing in Novato handled differently?

Often, yes. SMART is operated by the Sonoma-Marin Area Rail Transit District, a public agency. If the train, the crossing gates, signals, or SMART property played a role, a government claim to the district is generally due within six months, in addition to any claim against a driver. Photographs of the crossing equipment and the train or car number help.

Which Novato streets have the most crashes?

According to the 2024 Marin County Local Road Safety Plan, Diablo Avenue between Center Road and Reichert Avenue had 32 injury collisions from 2017 through 2021, the most of any Novato segment, followed by Novato Boulevard between Nave Court and Tamalpais Avenue with 28.

Can I sue the bar that served a drunk driver in Novato?

Generally not. Business and Professions Code section 25602 bars most civil claims against a business that served alcohol to an adult. The main exception is a sale to an obviously intoxicated minor. The claim usually runs against the driver and, where available, your own underinsured motorist coverage.
