This page provides general information about California law and local procedures as they apply to injuries in Tiburon and Belvedere. It is not legal advice, and reading it does not create an attorney-client relationship. Every case depends on its own facts. For advice about your specific situation, consult a licensed California attorney.
A Tiburon personal injury lawyer looking at the County’s data finds an unusual picture. On the peninsula’s own town and city streets, the County counted only four injury collisions in Tiburon and one in Belvedere from 2017 through 2021, none of them severe. On Tiburon Boulevard, the state highway that the plan calls the primary access road to both communities, it counted 50 collisions in the same five years, eight with severe injuries. The plan’s severe-injury data for the Tiburon Peninsula centers on that one road, and it flags Paradise Drive separately for speed and rear-end crashes.

I’m Sami Sedghani, a personal injury lawyer. My office is in downtown San Rafael on 4th Street, north of the peninsula on Highway 101. This page covers what is specific to injury claims in Tiburon and Belvedere: the three police agencies that may respond, the County’s findings on Tiburon Boulevard and Paradise Drive, the ferries, and where a claim against a public agency goes. For the general California rules, see our car accident page.
Three police agencies on one peninsula
Tiburon and Belvedere each have their own police department. The Tiburon Police Department is at 1155 Tiburon Boulevard and can be reached at (415) 789-2801. The Belvedere Police Department serves the City of Belvedere, the smallest jurisdiction in Marin by both area and population.
The third agency is the California Highway Patrol’s Marin Area office, which handles Highway 101 and unincorporated Marin County. Not every road on the way to the peninsula is inside either town. The County’s safety plan, for example, lists Paradise Drive among unincorporated Marin’s hot spots for driving or bicycling under the influence, so at least part of it is outside both. Which agency takes a report on those roads depends on exactly where the crash happened. The report itself will say, and that answer also points to which public entity, if any, could share responsibility.
Requesting the report
- Tiburon or Belvedere police: requests go to the department that responded. Neither department’s website posts a collision-report form that we could locate, so the practical route is to call the department with the case number. The Town of Tiburon’s general public records page says the Town responds to records requests within 10 days.
- CHP Marin Area: reports are requested through the CHP crash report request process.
- Eligibility: Vehicle Code § 20012 limits collision reports to people with a proper interest, including the drivers, injured people, their attorneys, and insurers.
Tiburon Boulevard (Highway 131): where the serious crashes are
Tiburon Boulevard is California State Route 131. Because it is a state highway, the County’s main analysis leaves it out, but the 2024 Marin County Local Road Safety Plan gives it a separate section covering the road from Highway 101 to Paradise Drive. Its findings for 2017 through 2021:
| Tiburon Boulevard, Highway 101 to Paradise Drive | 2017 to 2021 |
|---|---|
| Collisions | 50, including 8 with severe injuries and none fatal |
| Where they clustered | Toward the western end; hot spot between North Knoll Road and the Highway 101 ramps |
| Who was involved | 86% motor vehicles only, 6% motorcyclists, 6% bicyclists, 2% pedestrians |
| Bicycle collisions | Between North Knoll Road and Cecilia Way |
| Leading causes | Unsafe speed 54%, failure to yield to another driver 14%, unsafe starting or backing 8%, signal and sign violations 6% |

The plan also describes work on the corridor. A pedestrian-activated HAWK signal was installed at Tiburon Boulevard and Stewart Drive in 2023. The Blackfield Drive and Greenwood Cove Drive intersection was rebuilt in 2021 with tighter turns and shorter crosswalks. Caltrans projects were planned for crossings at Stewart Drive, Trestle Glen Boulevard, and Ned’s Way, and Caltrans was planning a State Highway Operation and Protection Program (SHOPP) project that would add Class IV separated bike lanes. When a crash happens in a work zone or at a newly changed intersection, the plans and signal settings in place that day can become evidence.
A claim that the highway itself was dangerous runs against the State, not the Town. Smaller highway damage claims are filed with Caltrans; larger claims go through the State’s Government Claims Program at the Department of General Services.
Paradise Drive: speed, rear-end crashes, and riders
Using ten years of data (2012 to 2021), the plan chose three emphasis areas for Tiburon: bicyclists, unsafe speed, and rear-end collisions. Unsafe speed caused 58 percent of Tiburon’s injury collisions, about double the county’s 28 percent, and rear-end collisions were also 58 percent, more than double the county’s 25 percent. Paradise Drive was the hot spot for both. About 11 percent of Tiburon’s injury collisions involved a bicyclist, and the plan notes that Tiburon’s roads are frequented by recreational riders.
A car coming up behind a rider or a group of riders is a common setting for these claims. The rules that usually decide them:
- Following distance. A driver may not follow more closely than is reasonable and prudent under Vehicle Code § 21703. In a rear-end crash, the following driver’s speed and distance are usually central questions.
- Passing a rider. A driver must pass at a safe distance (Vehicle Code § 21750) and leave at least three feet when passing a bicyclist (Vehicle Code § 21760), slowing or waiting when the road is too tight.
- Speed for conditions. The basic speed law in Vehicle Code § 22350 requires a speed that is reasonable for curves, visibility, and traffic, whatever the posted limit.
- Lane position. Vehicle Code § 21202 generally asks slower riders to keep right, but it has exceptions, including lanes too narrow to share safely, that often apply on Paradise Drive.
Paradise Drive also crosses jurisdictions. The County’s plan discusses it in its Tiburon chapter, its unincorporated Marin chapter, and its Corte Madera chapter, where the Town has a separate Paradise Drive project. A road-condition claim depends on which agency controls the exact spot.
Ferry passengers and the Tiburon waterfront
Two ferry services leave from downtown Tiburon. The Tiburon to San Francisco ferry is run by the Golden Gate Bridge, Highway and Transportation District, a public agency. Service to Angel Island State Park from Tiburon is offered by a separate operator, the Angel Island Tiburon Ferry. For a passenger injured boarding, riding, or leaving a ferry, California requires a carrier of passengers for reward to use the utmost care and diligence under Civil Code § 2100.
Which operator ran the boat changes the procedure. A claim against the Golden Gate District, as a public agency, generally must be presented within six months under Government Code § 911.2. A claim against a privately operated vessel generally follows the ordinary rules, and ticket terms or maritime law may also matter, so the ticket and booking confirmation are worth keeping. Downtown also draws crowds on event nights; the Tiburon Police Department posts closures of lower Main Street for the Tiburon Chamber’s Friday Night on Main event.
Claims against the Town, the City of Belvedere, or the State
A personal injury claim against the Town of Tiburon, the City of Belvedere, or the State is generally due within six months. Tiburon Town Hall is at 1505 Tiburon Boulevard. To hold an agency responsible for a road, a claimant generally must show a dangerous condition that the agency created, or knew or should have known about in time to fix, under Government Code § 835. For Tiburon Boulevard, that agency is usually Caltrans, through the State’s claims program. A lawsuit, if one follows, is generally filed in the Marin County Superior Court in San Rafael.
Tiburon’s ordinance limiting Class 2 (throttle) e-bikes to riders 16 and older took effect July 1, 2025, according to the County of Marin’s youth e-bike safety page. If a young rider is hurt, the two-year lawsuit deadline is generally paused until age 18 under Code of Civil Procedure § 352, but claims against public agencies still run on the six-month clock. Because the deadline depends on the facts, it is better to have a licensed California attorney determine the deadline that applies than to calculate it yourself.

How we prepare a Tiburon Peninsula injury case
Rear-end and speed crashes are often described as minor, and insurers value neck, back, and concussion injuries from them with skepticism. We answer that with the record: the vehicle damage, the treatment timeline, and what the medical notes actually say. I trained as a clinical pharmacist at UCSF, so we read those records with attention to medications, prior complaints, and gaps in care, the same points a defense reviewer will look for. Before founding Synergist Law, I spent nine years at large law firms representing companies in complex litigation, and I know how the other side frames these cases. None of that predicts how a case will end. It shapes how we prepare.

Frequently asked questions about Tiburon injury claims
Who responds to a crash on Tiburon Boulevard?
It depends on where along the road the crash happened. Inside the Town, the Tiburon Police Department generally responds. Near Highway 101 and in unincorporated stretches, the California Highway Patrol’s Marin Area office generally handles it. The report identifies the agency, which also matters for any later claim.
Does Belvedere have its own police department?
Yes. The Belvedere Police Department serves the City of Belvedere, separately from the Tiburon Police Department. A crash on a Belvedere street is generally a Belvedere police report.
Who is responsible for the condition of Tiburon Boulevard?
Tiburon Boulevard is State Route 131, a state highway, so a claim that the road itself was dangerous generally goes to the State, through Caltrans or the Department of General Services Government Claims Program depending on the amount, not to the Town. The claimant generally must show a dangerous condition the State created or knew about in time to fix.
Are Paradise Drive crashes common?
The 2024 Marin County Local Road Safety Plan identified Paradise Drive as Tiburon’s hot spot for both unsafe-speed and rear-end collisions from 2012 through 2021, and it listed Paradise Drive among unincorporated Marin’s hot spots for impaired driving or bicycling.
I was hurt on a Tiburon ferry. Is there a deadline?
If the Golden Gate Bridge, Highway and Transportation District ran the ferry, a claim generally must be presented to the District within six months under Government Code section 911.2. A claim against a private operator follows different rules, and the ticket terms may also matter. Because the deadline depends on the facts, it is better to have a licensed California attorney determine the deadline that applies than to calculate it yourself.
