This page provides general information only about California law and local procedures as they apply to injuries in Folsom. It is not legal advice, and reading it does not create an attorney-client relationship. Every case depends on its own facts. For advice about your specific situation, consult a licensed California attorney.
A Folsom car accident lawyer can work from recent City data. The City’s 2024 Local Road Safety Plan counted 2,076 reported collisions from 2020 through 2023. Thirteen were fatal and 54 caused severe injuries. Compared with the state, Folsom’s worst crashes more often involved an impaired driver: 39.5 percent of its fatal and severe-injury crashes, against 25.3 percent statewide. Below is what that plan says about specific streets, and what it means for a claim. We also cover who writes the report, how a claim against the City or SacRT works, and where a case is filed.

Our firm has one office, in San Rafael at 1299 4th Street, and we take injury cases in Folsom and the rest of Sacramento County. Clients meet with us by phone or video, or in person when we set that up. For the statewide rules, see our car accident page; for big-rig crashes on Highway 50, see our Sacramento truck accident page.
Who writes the report: Folsom police or the CHP
Inside city limits, the Folsom Police Department investigates crashes on City streets such as East Bidwell Street, Iron Point Road, and Folsom Boulevard. A Highway 50 accident is different. The CHP’s East Sacramento Area office, at 11336 Trade Center Drive in Rancho Cordova, patrols about 22 miles of US Highway 50. Its territory runs east to the El Dorado County line.
Folsom sits on two county lines, El Dorado to the east and Placer to the north. A crash a short way past either line belongs to a different CHP office or local agency, and any claim about the road goes to a different county. The location written on the report settles it.
How much does a Folsom police collision report cost?
The Folsom Police Department lists $16 for a vehicle collision report bought online. Its collision report page says the search needs three things: the collision date, a driver’s last name, and the report number. LexisNexis handles other payment options at 888-332-8244, and Folsom Police Records can be reached at 916-461-6400. CHP reports go through the CHP request process, and both agencies release reports only to people with a proper interest under Vehicle Code § 20012.
What Folsom’s 2024 road safety plan shows
City staff presented the 2024 plan to the City Council for adoption in February 2025, with a staff report summarizing it. Unsafe speed accounted for 27 percent of all crashes, red-light running for 14 percent, and DUI for 10 percent. Most crashes happened at intersections (80 percent), and the busiest window was 4 to 6 p.m. More than half of the fatal and severe crashes (53.5 percent) involved speeding, tailgating, or signal violations, compared with 33.1 percent statewide.
When the plan mapped injury crashes, three intersections led the City:
- Iron Point Road and East Bidwell Street: 12 injury crashes, 2020 to 2023.
- Iron Point Road and Prairie City Road: 12.
- Greenback Lane and Folsom Boulevard / Folsom-Auburn Road: 11.
The road segment with the most injury crashes was Prairie City Road between Highway 50 and a point north of White Rock Road, with 9. For that stretch, the plan proposes high-friction pavement on the curves, centerline and edgeline rumble strips, and a speed feedback sign. It also proposes a roundabout at East Bidwell Street and Orchard Drive. East Bidwell runs from the central business district across Highway 50 to the newer neighborhoods south of the freeway, and congestion there was among the concerns residents raised most often in the plan’s survey.
Folsom Lake Crossing and single-vehicle crashes
Twenty-eight percent of Folsom’s collisions involved a fixed object or a parked car. Hitting an object was also the most common type among fatal and severe crashes. Folsom Lake Crossing shows why. The City’s 2021 plan recommended median barriers between Folsom Dam Road and the Johnny Cash Trail entrance, and the City later won federal safety grants that funded a median barrier project there. The 2024 plan’s data, covering 2020 through 2023, shows one fatal crash and one severe-injury crash on the stretch between Gun Range Road and Folsom Dam Road.
Single-vehicle crashes raise their own questions. An injured passenger usually claims against the liability coverage of the car’s driver. When the road itself is blamed, the claim runs against the public entity under Government Code § 835. For public property, a barrier or rumble strip added after an injury “is not evidence that the public property was in a dangerous condition at the time of the injury” (Government Code § 830.5(b)). So these cases are built from the road as it was on the day of the crash.
Folsom car accident lawyer questions about drunk and speeding drivers
With impaired driving behind so many of Folsom’s worst crashes, these cases follow a familiar pattern. The claim usually runs against the drunk driver and that driver’s auto policy. That policy may carry only California’s minimum limits: $30,000 per person and $60,000 per accident for policies issued or renewed since 2025 (Vehicle Code § 16056). Your own underinsured motorist coverage may be the next layer. If the driver was on the job, the employer’s commercial coverage may apply. Whether the driver was acting for a business is a fact question, not an assumption.
The other driver’s insurer often calls within days and asks for a recorded statement. Hold off on recorded statements until you consult with a licensed attorney. California’s comparative fault rule (Li v. Yellow Cab Co. (1975) 13 Cal.3d 804) means a statement suggesting you were partly at fault can reduce what you recover.
Light rail, buses, and Highway 50 traffic
The Sacramento Regional Transit District runs light rail along the Folsom Boulevard corridor from the Historic District toward downtown Sacramento, plus local bus routes in Folsom. SacRT took over Folsom’s bus service after the City voted to annex it in late 2018. A carrier of passengers for reward owes them the utmost care and diligence under Civil Code § 2100. A claim against SacRT goes to its Clerk to the Board, 1102 Q Street, Suite 3000, Sacramento. Its claim instructions accept claims by mail or by personal delivery with an appointment, but not by fax or email.
Highway 50 through Folsom carries about 99,000 to 101,000 vehicles a day at the Folsom Boulevard interchange, including 5,050 to 5,940 trucks, by Caltrans’ 2024 truck traffic estimates. At Scott Road the estimate is 102,000 vehicles and 6,528 trucks. A big-rig case adds the motor carrier, its federal filings, and its electronic records; our truck accident page explains those.
Claims against the City of Folsom, the County, or the State
Before suing a public entity, an injured person generally has to present a written claim. Each entity takes its own claims:
- City of Folsom (City streets, signals, City vehicles). Under Government Code § 915, a claim against a city is delivered or mailed to its clerk or another officer the statute names. Folsom City Hall is at 50 Natoma Street.
- Sacramento County (unincorporated roads outside the city). Claims go to the Clerk of the Board of Supervisors, 700 H Street, Room 2450. The County’s claims page does not allow electronic submission.
- The State (Highway 50). Smaller claims can go to Caltrans, and larger ones to the Department of General Services.
- SacRT, as described above.
For personal injury, these claims are generally due within six months of the incident under Government Code § 911.2. Because the deadline depends on the facts, it is better to have a licensed California attorney determine the deadline that applies than to calculate it yourself.
Filing a Folsom case in Sacramento Superior Court
Folsom is in Sacramento County, so a lawsuit over a Folsom crash is generally filed in the Sacramento County Superior Court. Under Code of Civil Procedure § 395, the county where a defendant lives can also be a proper place. The court’s Civil Unit is in the Gordon D. Schaber Courthouse, 720 9th Street, Room 102, in downtown Sacramento. Its filing instructions accept civil papers by e-filing, mail, in person, or drop box. A lawsuit against a private driver or business generally has to be filed within two years of the injury under Code of Civil Procedure § 335.1. Because the deadline depends on the facts, it is better to have a licensed California attorney determine the deadline that applies than to calculate it yourself.

How we approach a Folsom crash case
In an impaired-driving case, we look for the DUI arrest records, any blood or breath results, and where the driver had been. In a single-vehicle crash on a curve, we look at the road surface, the signs, and the lighting as they were that night. Then we read the medical chart. Sami is a former clinical pharmacist who trained at UCSF, which matters when the defense blames symptoms on an old injury or a medication. Before founding Synergist Law, he spent nine years at large law firms representing companies in complex litigation. That experience does not predict an outcome. It informs how we build the file.
Choosing a Folsom personal injury lawyer
When you choose a Folsom personal injury lawyer, a local office is a convenience, not a qualification. Every California-licensed lawyer is licensed to practice in every county in the state. The questions worth asking any lawyer you interview, including us, are about the advocacy itself. Does the lawyer have experience with the kind of case you have, and a clear strategy for proving it? Do you trust that lawyer to tell you the truth about it?
