This page provides general information about California law and local procedures as they apply to injuries in Oakland. It is not legal advice, and reading it does not create an attorney-client relationship. Every case depends on its own facts. For advice about your specific situation, consult a licensed California attorney.
This page explains what an Oakland car accident lawyer or truck accident lawyer looks at first after a crash in the city. Oakland sits where I-880, I-580, I-980, and the Bay Bridge approach meet, next to the Port of Oakland’s container terminals. If you were hurt in a crash there, the first practical questions are local ones. Did Oakland police or the CHP take the report? Is the street on the City’s High Injury Network? Is the City, the State, AC Transit, or BART involved? Those answers decide who you file against and which deadline applies.

Synergist Law is led by attorney Sami Sedghani, a personal injury lawyer. Our office is in downtown San Rafael on 4th Street, across the Richmond-San Rafael Bridge from the East Bay on I-580. We work with Oakland clients by phone and video, and in person when a case calls for it. For the general California rules, see our pages on car accidents, truck accidents, and commercial vehicle accidents.
What Oakland’s own crash data shows
The Oakland Department of Transportation (OakDOT) maps the streets where severe and fatal crashes concentrate. Its 2024 High Injury Network uses five years of finalized crash data, 2017 through 2021. According to OakDOT’s 2024 High Injury Network presentation, the network covers 66 miles, about 8 percent of Oakland’s streets. Those 66 miles account for 342 fatal and severe injuries, 63 percent of the citywide total (the City’s HIN webpage gives the figure as 60 percent).
| High Injury Network corridor | From | To |
|---|---|---|
| International Boulevard | 5th Avenue | Durant Avenue |
| Foothill Boulevard | 9th Avenue | MacArthur Boulevard |
| MacArthur Boulevard | Fruitvale Avenue | Taylor Avenue |
| San Pablo Avenue | 16th Street | 67th Street |
| Telegraph Avenue | 15th Street | 58th Street |
| Broadway | 7th Street | West MacArthur Boulevard |
| 7th Street | Mandela Parkway | 5th Avenue |
| Hegenberger Road | Edgewater Drive | International Boulevard |
In its 2024 Safe Oakland Streets annual report (April 2025), OakDOT and the Oakland Police Department listed the most common causes of fatal and severe crashes in the city. They were driver failure to yield, disobeying signs and signals, unsafe turning, and speeding. The same report describes the International Boulevard Quick Build, which added more than 3,000 posts along about 5.7 miles, separating bus lanes from general traffic and lining the center line.
| Year | All traffic deaths | Pedestrians | Bicyclists | Motorcyclists | Drivers and passengers |

Do Oakland’s speed cameras record crashes?
Generally not in a way that helps a claim. Oakland’s speed safety cameras began issuing tickets on March 15, 2026, at 18 locations such as Hegenberger Road and International Boulevard at 40th Avenue. Under the City’s program rules, they take still photos of the rear license plate only, with no video. Photos are kept five days if no violation is issued, and the footage may not be shared or used for any other purpose.
What the data can and cannot do in a claim
Most crashes trace back to a driver and that driver’s insurance. When the road itself contributed, Government Code § 835 allows a claim against the public entity for a dangerous condition of its property. The injured person generally has to show the entity created the condition or had actual or constructive notice of it in time to protect against it. A place on the High Injury Network does not prove a dangerous condition. Public entities have defenses, including design immunity under Government Code § 830.6. And under 23 U.S.C. § 407, some safety reports and data compiled for federal highway safety programs cannot be obtained in discovery or admitted into evidence in a damages case. Whether it reaches a particular City document is a legal question.
The first two weeks: what an Oakland car accident lawyer looks at
On Oakland streets and freeways alike, the first two weeks shape a claim more than people expect:
- The first medical record. Early care, and a first note that describes how the crash happened, carry weight. Insurers point to treatment gaps to argue the injury came from something else.
- If anyone was injured, or property damage exceeded $1,000, each driver must file an SR-1 report with the DMV within 10 days (Vehicle Code § 16000), whether or not police wrote a report.
- Recorded statements. The other driver’s insurer may call quickly and ask for a recorded statement. That insurer is gathering evidence for its own insured. Hold off on recorded statements until you consult with a licensed attorney.
- Your own policy may include medical payments coverage, which can pay medical bills regardless of fault, and uninsured or underinsured motorist coverage if the other driver has little or no insurance.
- Fault is often shared. California uses comparative fault, so an unsafe lane change or a turn on a stale yellow can shift part of the responsibility. A share of fault generally reduces a recovery rather than barring it, although California generally bars pain-and-suffering damages for an injured person who was driving uninsured, owned an uninsured vehicle involved in the crash, or was convicted of DUI for the crash, with some exceptions (Civil Code § 3333.4).
- Vehicles and video. Photographs of the vehicles before repair and business cameras facing the intersection can become evidence. Private video is often overwritten within days.
Who takes the report after an Oakland crash
On city streets, the Oakland Police Department takes collision reports. According to OPD’s vehicle collision reports page, reports are generally ready 60 to 90 days after the collision. They can be bought online through BuyCrash, or requested in person or by mail from the Traffic Investigations Unit at the Eastmont Substation, 2651 73rd Avenue. Fatal collision reports are available only in person or by mail, and a third party needs a signed authorization from someone involved.
On I-880, I-580, I-980, Highway 24, Highway 13, and the I-80 approach to the Bay Bridge, the responding agency is the California Highway Patrol. The CHP Oakland Area office, at 3601 Telegraph Avenue near the Highway 24 and I-580 junction, serves Oakland, Berkeley, Piedmont, Emeryville, and nearby cities. CHP reports are requested through the CHP crash report process. An Oakland car accident attorney usually starts by confirming which agency responded, because a ramp crash can go either way. Under Vehicle Code § 20012, reports go only to people with a proper interest, such as the drivers, injured persons, vehicle owners, and their attorneys.
I-880, I-580, and the Bay Bridge approach
Trucks over 4.5 tons (9,000 pounds) are barred from I-580 between Foothill Boulevard in San Leandro and Grand Avenue in Oakland, an 8.7-mile stretch, under a restriction that began on MacArthur Boulevard in the 1950s and carried over when the freeway opened in the early 1960s. Caltrans’ I-580 Truck Access Study is examining what lifting it would do, with a final report due in late 2026 or early 2027; Caltrans says only the Legislature could remove the ban. Through Oakland, heavy trucks use I-880 instead, and the truck counts below show the difference.
If a state highway condition contributed to a crash, the claim against the State is not filed with the City. Under Caltrans’ claim instructions, claims of $12,500 or less can go to Caltrans directly, and larger claims go to the Department of General Services Government Claims Program, generally within six months. Because the deadline depends on the facts, it is better to have a licensed California attorney determine the deadline that applies than to calculate it yourself.
Oakland truck accident lawyer: I-880, the Port, and West Oakland
A truck is usually run by a business that must follow federal and California safety rules and carries more insurance than a passenger car. Its records of speed, braking, and driver hours can be lost within months. These are the local questions an Oakland truck accident lawyer looks at first.
How much truck traffic runs through Oakland?
A great deal, most of it on I-880. In Caltrans’ 2024 truck counts, I-880 at the Route 77 junction and at Oak and Madison Streets had the second- and third-highest truck volumes of any location in Caltrans District 4, the nine-county Bay Area district. Only I-580 at First Street in Livermore was higher. Near downtown, about one vehicle in ten on I-880 is a truck, and about half of those have five or more axles, the typical big rig.
| Location | All vehicles per day | Trucks per day | Trucks with 5 or more axles |
|---|---|---|---|
| I-880 at the Route 77 junction | 205,000 to 207,000 | 19,680 to 21,321 | 10,234 to 10,916 |
| I-880 at Oak and Madison Streets | 194,000 | 20,758 | 10,711 |
| I-880 at Hegenberger Road | 212,000 | 16,197 | 8,388 |
| I-980 at the I-880 junction | 91,000 | 6,397 | 2,669 |
| I-80 at the Bay Bridge Toll Plaza | 231,000 | 5,798 to 5,960 | 2,016 to 2,617 |
| I-580 at High Street (truck-restricted segment) | 131,000 to 147,000 | 550 to 588 | 25 to 28 |
The seaport sits beside I-880 in West Oakland. The Port of Oakland handled 2,253,976 twenty-foot container units (TEUs) in 2025, split about evenly between imports and exports. In West Oakland, 7th Street is on the High Injury Network from Mandela Parkway to 5th Avenue. The Alameda County Transportation Commission is rebuilding the 7th Street railroad underpass between I-880 and Maritime Street to raise clearances for trucks. Its spring 2026 fact sheet calls the underpass a key access point to the Port and expects completion by summer 2029. In a work-zone crash, the contractor’s traffic control plan can become evidence.
Who investigates a truck crash in Oakland?
The same agencies that handle car crashes: Oakland police on city streets such as 7th Street, and the CHP on the freeways, usually its Oakland Area office. The CHP’s Golden Gate Division Motor Carrier Safety Unit inspects carrier terminals in the nine Bay Area counties and lists inspections of commercial vehicles involved in collisions among its duties.
On I-880 in southern Alameda County, the CHP also runs the Nimitz Commercial Vehicle Enforcement Facility, which weighs and inspects trucks.
Markings on the truck. The cab door usually shows the company name and USDOT number, and the chassis may belong to a different company. The Federal Motor Carrier Safety Administration’s Company Snapshot shows a carrier’s registration, insurance on file, and crash history by USDOT number.
The carrier moves first. A motor carrier’s insurer often sends an adjuster or investigator soon after a serious crash. Hold off on recorded statements until you consult with a licensed attorney.
Safety rules that come up in Oakland truck cases
A violation of a safety rule can be evidence of negligence. Our truck accident page explains these rules in detail.
- Hours of service. Interstate drivers for property carriers may drive no more than 11 hours and may not drive after the 14th hour on duty (49 CFR § 395.3). California intrastate drivers may drive up to 12 hours after 10 hours off duty (Cal. Code Regs., tit. 13, § 1212.5).
- Driver qualification. Drivers must be qualified, including being at least 21 with a valid commercial license (49 CFR § 391.11), and the carrier keeps a file on each (49 CFR § 391.51).
- Insurance minimums. Generally at least $750,000, both for interstate for-hire carriers of nonhazardous freight (49 CFR § 387.9) and for California motor carriers of property (Veh. Code § 34631.5).
- Terminal inspections. Under California’s Basic Inspection of Terminals (BIT) program, a carrier must make its vehicles and records available to the CHP at its terminals (Veh. Code § 34501.12). Covered trucks must be inspected at least every 90 days (Veh. Code § 34505.5).
- Truck speed limit. 55 mph on I-880 and every other California highway for trucks with three or more axles or pulling a trailer (Veh. Code § 22406).
Evidence in an Oakland truck case, and how long it lasts
Much of the evidence belongs to the carrier, and some of it is kept only for a limited time. An Oakland truck accident attorney usually sends a written preservation letter early that identifies what has to be kept:
- Engine control module (ECM) data: speed, throttle, and braking in the seconds before impact.
- Electronic logging device and hours-of-service records: at least six months (49 CFR § 395.8(k)).
- The driver qualification file (employment plus three years) and 90-day inspection records (two years).
- The accident register: three years after each accident (49 CFR § 390.15).
- Dispatch and load records, such as bills of lading, container interchange records, and broker agreements, which show who controlled the trip.
- Dashcam and telematics video, often overwritten on a routine cycle, and business video along the route, often gone within days.
Who may be responsible, and what insurance applies
A truck crash often involves more than one company, and the value of a claim depends heavily on who the defendants are:
- The driver, for unsafe driving, fatigue, or distraction.
- The motor carrier, for an employee driver acting within the scope of employment, and directly for negligent hiring or maintenance. Under federal leasing rules, the lease must give a carrier that leases an owner-operator’s truck “exclusive possession, control, and use” of it for the duration of the lease (49 CFR § 376.12(c)(1)).
- The shipper or loader, when improper loading caused the crash, and in some cases the broker that selected the carrier.
- A maintenance shop or manufacturer, for defective brakes, tires, or other parts; see product liability.
- A public entity, when a dangerous road condition contributed, subject to the six-month government claim described below.
The name on the container or trailer does not settle who employed the driver. Port drayage drivers may be employees, leased owner-operators, or independent contractors. Which one, and which company controlled the work, is a fact question usually developed in discovery. California’s terminal-inspection statute itself says that complying with its leasing provisions does not imply an employee-employer relationship (Veh. Code § 34501.12(b)(2)).
Coverage differs just as much. An individual driver may carry only California’s minimum limits: $30,000 per person and $60,000 per accident for bodily injury, for policies issued or renewed since January 1, 2025 (Veh. Code § 16056). A business usually has a commercial policy, sometimes with excess layers that surface only in discovery. Your own uninsured and underinsured motorist coverage can matter either way.
Delivery vans raise their own questions about who controlled the driver. See our pages on delivery driver accidents, UPS truck accidents, FedEx truck accidents, and Amazon delivery accidents.
Pedestrians, bicyclists, and motorcyclists in Oakland
In 2024, 19 of the 30 people killed were walking or biking, according to the City’s 2024 Safe Oakland Streets report. From January through September 2026, 13 of the 20 people killed were pedestrians.
What an Oakland pedestrian accident lawyer looks at first
An Oakland pedestrian accident lawyer usually starts with the crossing itself: whether it was marked, the signal phase, and whether the driver was turning. Under Vehicle Code § 21950, a driver must yield to a pedestrian in a marked or unmarked crosswalk at an intersection. Five of the 20 intersections on the City’s 2024 list are on International Boulevard in East Oakland, where AC Transit buses, turning cars, and people walking share the corridor.
What an Oakland bicycle accident lawyer looks at first
An Oakland bicycle accident lawyer looks at passing distance, door zones, and the bike lane design. Vehicle Code § 21760 requires drivers passing a bicyclist in the same direction to leave at least three feet. Telegraph Avenue, Grand Avenue, and Claremont Avenue are all on the High Injury Network.
What an Oakland motorcycle accident lawyer looks at first
An Oakland motorcycle accident lawyer often hears the same defense first: that the rider was lane splitting or speeding. California permits lane splitting, and Vehicle Code § 21658.1 defines it. Whether a rider did it safely is a fact question. Five motorcyclists died on Oakland streets in 2025, up from two in each of 2023 and 2024. Our motorcycle accident page explains how fault is decided.
Waymo and self-driving cars in Oakland
Waymo has state approval to expand driverless service into Oakland. The DMV approved an expanded operating area on November 21, 2025. In its January 2026 filing with the CPUC, Waymo listed Oakland, Alameda, and Berkeley among the cities newly added to its service area. The CPUC approved that filing on August 14, 2026. As of October 29, 2026, Waymo’s own Bay Area rider page describes service on the Peninsula from San Francisco to San Jose and does not list Oakland. Approval and public rides are not the same thing, so dates matter in any Waymo Oakland claim.
Under Vehicle Code § 38750, autonomous vehicles must capture sensor data for at least 30 seconds before a collision. Waymo’s Terms of Service (last updated September 29, 2026) include JAMS arbitration, a 45-day informal resolution step, a two-year claim notice, and a 30-day email opt-out. A pedestrian, cyclist, or other driver who was never a rider did not agree to those terms. Since July 1, 2026, when the DMV’s implementing notice took effect, Vehicle Code § 38752 also provides for notices of autonomous vehicle noncompliance. See our pages on self-driving car accidents and Waymo accidents.
AC Transit, BART, and other public agencies
Several public agencies operate in Oakland, and each one receives its own claims. Each has a six-month claim deadline for personal injury under Government Code § 911.2. Because the deadline depends on the facts, it is better to have a licensed California attorney determine the deadline that applies than to calculate it yourself.
- City streets and City vehicles: the City of Oakland. The Oakland City Attorney’s Office accepts claims by email at claims@oaklandcityattorney.org or by mail to 1 Frank H. Ogawa Plaza, 6th Floor, Oakland, CA 94612.
- AC Transit buses: the Alameda-Contra Costa Transit District. Under its claims instructions, a signed original Claim for Damages form goes to the District Secretary at 1600 Franklin Street, Oakland, CA 94612. AC Transit does not accept claims by fax or email.
- BART trains, stations, and parking lots: the San Francisco Bay Area Rapid Transit District, a separate public entity from the City and AC Transit. Its claims address should be confirmed directly with BART.
- County property and County vehicles: the County of Alameda. Claims are filed with the Clerk of the Board of Supervisors, Administration Building, 1221 Oak Street, Room 536, as described on the County’s claims page.
- State highways, including I-880, I-580, I-980, the Bay Bridge approach, and some surface streets that are also state routes, such as parts of International Boulevard (Route 185) and San Pablo Avenue (Route 123): Caltrans or the Department of General Services, as described above. Which agency owns a particular stretch is a question to confirm early.
- Port of Oakland property, such as seaport roads: the Port is the City of Oakland acting through its Board of Port Commissioners, and it has its own government claim form, which goes to the Secretary of the Board of Port Commissioners at 530 Water Street, Oakland.
Where an Oakland case is filed
Injury lawsuits arising in Oakland are generally filed in the Alameda County Superior Court. Under the court’s judicial assignments effective August 10, 2026, its Civil Direct Calendar departments sit in two buildings. One is the Administration Building at 1221 Oak Street in Oakland, next to the René C. Davidson Courthouse at 1225 Fallon Street. The other is the Hayward Hall of Justice at 24405 Amador Street. The court assigns each case to a department after it is filed, and the court’s eCourt Public Portal shows the assigned department.
The deadlines are the same as anywhere in California. An injury lawsuit against a private person or company generally must be filed within two years of the injury (Code of Civil Procedure § 335.1). A claim for damage to a vehicle or other property generally must be filed within three years (§ 338). When a public entity is involved, the six-month government claim comes first, and missing it can end the claim against that entity no matter how strong the facts are. A child’s injury claim usually has more time, but the six-month government claim deadline is not paused the same way. Because the deadline depends on the facts, it is better to have a licensed California attorney determine the deadline that applies than to calculate it yourself.
What an Oakland wrongful death lawyer looks at first
An Oakland wrongful death lawyer first identifies who may bring the claim. Code of Civil Procedure § 377.60 generally gives that right to a spouse or domestic partner, children, and others the statute lists. OPD releases fatal collision reports only in person or by mail, and a third party generally needs a death certificate or an authorization. Our wrongful death page explains the California rules.
How we approach an Oakland injury case
Our first step is to pin down the facts that are hardest to rebuild later. Those include the agency report, the intersection’s signal timing, nearby business or traffic video before it is overwritten, and whether the location is on OakDOT’s High Injury Network. Sami spent nine years at large law firms handling complex and product liability litigation for companies, and that is where he learned which gaps a defense team tends to look for first. We try cases in Alameda County courts, and we currently have a case pending in Alameda County Superior Court.
Sami is also a former clinical pharmacist, and we read the medical records closely: the imaging, the medication history, and whether the treating notes connect the crash to the diagnosis. None of that predicts the result in any case. It is how we prepare one.
Choosing an Oakland personal injury lawyer
When you choose an Oakland personal injury lawyer, or any lawyer for an injury outside Marin, a local office is a convenience, not a qualification. Every California-licensed lawyer is licensed to practice in every county in the state. The questions worth asking any lawyer you interview, including us, are about the advocacy itself. Does the lawyer have experience with the kind of case you have, and a clear strategy for proving it? Do you trust that lawyer to tell you the truth about it?
Other Bay Area cities: Fremont injury claims, San Jose injury claims, San Mateo injury claims, San Francisco injury claims, all areas we serve, and Marin County injury claims, where our office is.
Other cases we handle in Oakland
Crashes get the most space on this page, but we handle other injury cases for people hurt in Oakland too:
- Motorcycle accidents
- Truck accidents, including big rigs and other heavy trucks
- Delivery van and commercial vehicle accidents, including Amazon, FedEx, and UPS vehicles
- Lyft and rideshare accidents
- Bicycle and e-bike accidents
- Self-driving car and Waymo accidents
- Slip and fall injuries and other premises liability cases
- Brain, spinal cord, and other catastrophic injuries
- Wrongful death claims
- Nursing home abuse and elder neglect
- Medication and pharmacy errors
- Defective products
Each of those pages explains the California law for that kind of case. The local details on this page, such as which agency takes the report and where a claim or lawsuit is filed, apply to all of them.
Frequently asked questions about Oakland injury claims
Who takes the report after a Bay Bridge accident or a crash on I-880 in Oakland?
The California Highway Patrol handles crashes on the Bay Bridge and its approach, I-880, I-580, I-980, and the other state freeways. On the Oakland side, that is usually the CHP Oakland Area office at 3601 Telegraph Avenue. Crashes on city streets are handled by the Oakland Police Department.
Which Oakland streets have the most severe crashes?
OakDOT’s 2024 High Injury Network identifies about 8 percent of the city’s streets that account for about 60 percent of fatal and severe injury crashes from 2017 through 2021, according to the City’s HIN page (OakDOT’s presentation puts the figure at 63 percent across 66 miles). It includes International Boulevard, Foothill Boulevard, MacArthur Boulevard, San Pablo Avenue, Telegraph Avenue, and Hegenberger Road.
How do I file a claim against the City of Oakland?
The Oakland City Attorney’s Office accepts claims by email at claims@oaklandcityattorney.org or by mail to 1 Frank H. Ogawa Plaza, 6th Floor. For personal injury, a claim against a California public entity generally must be filed within six months of the incident. Because the deadline depends on the facts, it is better to have a licensed California attorney determine the deadline that applies than to calculate it yourself.
How do I file a claim against AC Transit after a bus crash?
AC Transit requires a signed original Claim for Damages form, delivered or mailed to the District Secretary at 1600 Franklin Street in Oakland. It does not accept claims by fax or email. The six-month government claim deadline generally applies to personal injury claims against the district. Because the deadline depends on the facts, it is better to have a licensed California attorney determine the deadline that applies than to calculate it yourself.
Where is an Oakland injury lawsuit filed?
Generally in the Alameda County Superior Court. Under the court’s August 2026 assignments, its Civil Direct Calendar departments sit in the Administration Building at 1221 Oak Street in Oakland and at the Hayward Hall of Justice. The court assigns each case to a department after it is filed, and the court’s eCourt Public Portal shows the assigned department.
How many trucks use I-880 through Oakland?
Caltrans’ 2024 data estimates 19,680 to 21,321 trucks a day on I-880 at the Route 77 junction, out of about 205,000 to 207,000 vehicles, and 20,758 at Oak and Madison Streets. Those are the second- and third-highest truck counts in the nine-county Bay Area district.
Is Waymo operating in Oakland?
Waymo has state approval to expand into Oakland. The CPUC approved its expanded service area, which Waymo’s filing says includes Oakland, on August 14, 2026. As of October 29, 2026, Waymo’s Bay Area rider page describes service from San Francisco to San Jose and does not list Oakland.
